TERMS OF USE, PURCHASE, SHIPPING & RETURNS POLICY

Welcome to Riverton Music, Inc. (“Riverton Music,” “we,” “us,” or “our”). These Terms govern your access to and use of our website located at www.rivertonmusic.com, any related mobile applications, and any services, purchases, rentals, or content offered through them (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any posted Rental or Service Agreements, form the entire agreement between you and Riverton Music regarding Site use and purchases, unless a separate written agreement signed by both parties states otherwise.

You may not modify or supplement these Terms through purchase orders, emails, checkout notes, or other documents. Any additional or different terms are void unless expressly agreed to in writing by Riverton Music.

2. USE OF THE SITE

You may use the Site only for lawful, personal, non-commercial purposes. You agree not to misuse or disrupt the Site, attempt unauthorized access, scrape or exploit content, or violate applicable laws or regulations.

We reserve the right to suspend or terminate access for violations.

3. LICENSE AND INTELLECTUAL PROPERTY

Riverton Music grants you a limited, revocable, non-transferable license to view Site content for personal use only. All trademarks, logos, text, images, audio, video, and software remain the exclusive property of Riverton Music or its licensors.

No ownership rights are transferred.

4. ACCOUNT REGISTRATION

Some Site features require account creation. You agree to provide accurate information, safeguard your login credentials, and notify us of unauthorized access. You are responsible for all activity under your account.

5. PRODUCT INFORMATION, PRICING & AVAILABILITY

We strive for accuracy, but product descriptions, prices, and availability may change or contain errors. Prices are not reserved until checkout. We reserve the right to correct errors or cancel orders.

If a product materially differs from its description, your remedy is return under our Return Policy.

6. ORDER PLACEMENT & ACCEPTANCE

Submitting an order is an offer to purchase. Orders are not binding until accepted by Riverton Music, which occurs when we process payment, deliver items in-store, or ship your order.

We reserve the right to refuse, limit, or cancel orders at our discretion.

7. PAYMENT TERMS

Accepted payment methods are displayed at checkout or provided in-store. We may require verification and may delay or cancel orders for security or fraud prevention.

Financing, promotional payment plans, or store credit programs (if offered) are governed by their own terms.

8. LIMITED-QUANTITY & SPECIAL-ORDER ITEMS

Vintage, limited-edition, closeout, exclusive, and special-order items are sold on a first-come, first-served basis. Deposits or preorders do not guarantee availability. If an item cannot be fulfilled, any deposit will be refunded.

Certain limited items may have modified return eligibility.

9. MANUFACTURER WARRANTIES

Most new products are sold with a manufacturer’s limited warranty, if any. Warranty coverage varies by product.

Except where required by law, Riverton Music provides no separate automatic warranty and disclaims implied warranties to the maximum extent permitted.

10. REPAIR & SERVICE DISCLAIMER

Repair and service work may be performed in-house, through third parties, or via referral. Customers are responsible for all charges. Riverton Music is not responsible for loss or damage not caused by our workmanship or handling.

Items not picked up and paid for within 90 days after notification may be considered abandoned as permitted by law.

RETURNS POLICY

11. All Sales are Final

(Limitations and exclusions apply)

All sales are final on serialized inventory.  In-store purchases may qualify for an exchange/upgrade for a similar or higher priced item.

• We do not do cash/card refunds, but can replace a defective item with another of equal value.
• All sales are FINAL on serialized inventory, musical instruments, holiday, clearance or special-order items.

Mail Returns

Mail returns require a Return Authorization (RA). Credit/exchanges are processed after inspection. Return shipping costs are the customer’s responsibility unless the return is due to our error.

16. ABUSE OF RETURN PRIVILEGES

We reserve the right to restrict or revoke return privileges for excessive or improper returns.

Domestic Shipping Policy

Shipment Processing Time

All orders are processed within 2-3 business days. Orders are not shipped or delivered on weekends or holidays.

If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

Shipping Rates & Delivery Estimates

Shipping charges for your order will be calculated and displayed at checkout.

* Overnight delivery is only available for orders with delivery addresses within the continental United States.

Delivery delays can occasionally occur.

Shipment to P.O. boxes or APO/FPO addresses

Riverton Music ships to addresses within the U.S., U.S. Territories, and APO/FPO/DPO addresses.

Shipment Confirmation & Order Tracking

You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours.

Customs, Duties and Taxes

Riverton Music is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

Damages

Riverton Music is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim.

Please save all packaging materials and damaged goods before filing a claim.

International Shipping Policy

We currently do not ship outside the U.S.

19. SHIPPING DELAYS

Orders may be delayed due to verification, inventory transfers, weather, or carrier issues.

20. TITLE & RISK OF LOSS

All shipments are made pursuant to a shipment contract. Ownership and risk of loss transfer to you upon delivery to the carrier.

21. PRIVACY POLICY INCORPORATION (NEW)

Your use of the Site is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and processing of information as described in the Privacy Policy.

22. ELECTRONIC COMMUNICATIONS & CONSENT (NEW)

By using the Site or making a purchase, you consent to receive communications from Riverton Music electronically, including order confirmations, notices, disclosures, and policy updates. Electronic communications satisfy any legal requirement that such notices be in writing.

23. TAXES & COMPLIANCE (NEW)

Sales tax is charged where required by law. You are responsible for any applicable taxes, duties, or fees not collected at checkout. Tax-exempt purchases require valid documentation prior to purchase.

24. FORCE MAJEURE (NEW)

Riverton Music is not liable for delays or failures caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, carrier delays, labor disruptions, supply chain interruptions, system outages, or governmental actions.

25. DISCLAIMER OF WARRANTIES

The Site is provided “as is” and “as available.” Riverton Music makes no guarantees regarding uninterrupted access, error-free operation, or content accuracy.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Riverton Music is not liable for indirect, incidental, or consequential damages. Total liability will not exceed the amount paid for the product or service giving rise to the claim.

27. DISPUTE RESOLUTION & ARBITRATION (NEW)

Any dispute arising out of or relating to these Terms, the Site, or any purchase shall be resolved through binding individual arbitration, rather than in court, except that either party may seek relief in small-claims court where permitted.

• Arbitration will be conducted on an individual basis only

• Class actions and representative actions are waived

• The arbitration will take place in Utah, unless otherwise required by law

You and Riverton Music waive the right to a jury trial to the fullest extent permitted by law.

28. INDEMNIFICATION

You agree to indemnify and hold harmless Riverton Music from claims arising from your misuse of the Site or violation of these Terms.

29. GOVERNING LAW

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

30. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in effect.
